Can business put waste in a household bin? UK trade waste law
No. By law, any waste produced by a business is “commercial waste” and cannot be put out in a household bin or collected by a council’s household kerbside service — even for a small firm working from home.
Every business has a legal Duty of Care to dispose of its waste through a registered carrier and to keep the paperwork to prove it. Getting this wrong can mean a fixed penalty of £300, or a fine of up to £5,000 on prosecution.
What counts as business waste?
If waste is produced by, or as a result of, any business activity, it is commercial waste — regardless of how much there is or where the business operates. That includes offices, shops, cafés, salons, workshops, tradespeople and people running a business from home. A joiner’s offcuts, a salon’s packaging, a takeaway’s food waste and an office’s paper are all commercial waste.
The law: your Duty of Care
Under Section 34 of the Environmental Protection Act 1990, anyone who produces business waste must ensure it is stored, transported and disposed of safely and legally. In practice that means you must:
- Use a registered waste carrier to remove your waste;
- Keep a Waste Transfer Note for every collection (kept for at least two years);
- Describe your waste accurately so it can be handled correctly.
What are the penalties?
Putting business waste in a household bin, or failing to produce your paperwork on request, is a criminal offence. Enforcement officers can issue a Fixed Penalty Notice of £300 under Section 34A, or prosecute — where the maximum fine is £5,000. If your waste is later fly-tipped by an unregistered carrier you handed it to, you can also be held liable.

Frequently asked questions
Can a sole trader or home business use their household bin?
No. If the waste comes from your business activity it is commercial waste, even if you work from home. Household bins are only for household waste. You’ll need a separate business waste arrangement for anything your business produces.
Is a receipt from the tip enough to prove I’ve disposed of it legally?
Not on its own. For business waste you need a Waste Transfer Note (or an annual “season ticket” version) showing who took the waste, when, and where it went — and the carrier must be registered.
What is a Waste Transfer Note?
It’s the record that transfers responsibility for the waste from you to the carrier. It lists the waste type, quantity, both parties and the carrier’s registration. You must keep it for at least two years and produce it if asked.
Do I need a collection if I only produce a tiny amount of waste?
Yes — there’s no minimum. Even very small volumes must go through a compliant route. For low volumes, a small bin on a scheduled collection or an occasional skip is usually the most cost-effective option.
